First-Time DUI in Michigan: What Happens to Your Driver’s License?

A person in a dark uniform writes notes on a clipboard beside an open car window, with an orange seat visible inside the vehicle.

A first DUI can leave Michigan drivers with plenty of questions. Will your license be suspended? Can you still drive to work? What happens if you refused a breath or chemical test?

In Michigan, DUI offenses are generally referred to as Operating While Intoxicated (OWI). While a first OWI does not necessarily mean permanently losing your driving privileges, the consequences can vary depending on the circumstances of the case, your BAC, your driving history, and other factors.

It is also important to understand that your criminal OWI case and your driver's license status are separate issues. A court outcome does not automatically resolve every administrative action involving the Michigan Department of State.

Could Your License Be Restricted?

Depending on the circumstances, a first OWI may result in a suspension or restrictions on your driving privileges. If you receive a restricted license, you must follow the specific conditions of that restriction. Driving outside those limitations can lead to additional legal and licensing consequences.

A chemical-test refusal can create another potential license issue. Michigan's implied-consent laws establish separate procedures and deadlines for challenging certain administrative suspensions. Resolving the criminal case does not necessarily resolve a chemical-test refusal.

What Should You Do After a First OWI?

Start by determining exactly what is happening with your driving privileges. Obtain your driving record, review your license status, and pay close attention to any deadlines in paperwork you receive.

If your license has been suspended, revoked, or restricted, understanding your options early can be critical. License reinstatement in Michigan may involve specific documentation, hearings, evaluations, and other requirements depending on the reason for the licensing action.
