Some courts are so behind and short-staffed that court dates are being set months into the future. When it comes to OWI arrests and procedures, it’s fair to say that every single police agency, prosecutor’s office, and court in Southeastern Michigan operates differently. In Washtenaw County, for first-offense drunk driving arrests, a driver is typically released from the station, hospital or jail and is notified of criminal charges weeks (or sometimes months) later.  However, if there’s an “aggravating factor” such as a high blood alcohol level, a prior conviction or an injury accident, police will often seek a warrant for the person’s arrest or request an immediate Arraignment. Didn’t Pay Your Reinstatement Fee? This Could Set You Back!

There are many difficult steps involved in the driver’s reinstatement process, including the possibility of attending a revocation appeal hearing or reexamination process. The last step is typically paying a license reinstatement fee to the Michigan Secretary of State. The fee, which is normally set at $125, is a processing cost for Michigan to actually and legally reinstate a license.  If you don’t pay the fine, you’ll be driving unlawfully even after undergoing a successful license appeal hearing or waiting until a your suspension period ends. If you’re caught, you may face additional license sanctions and criminal charges for not paying the reinstatement fee.

If a person applies using the old forms, he or she might have his or her application rejected or significantly delayed. Effective August 2021, The Michigan Secretary of State Requires New Forms for Driver’s License Appeals

The Michigan Secretary of State has a specific division which governs driver’s license revocation appeals. This division has undergone several name changes in the last decade – currently it’s called the Office of Hearings and Administrative Oversight (OHAO) but was previously known as the Administrative Hearing Section (AHS), and before that as Driver’s Assessment and Appeal Division (DAAD), and before that as Driver’s License Appeals Division (DLAD). Just as it changes names frequently, the Division often changes the forms and requirements a person must complete to have a driver’s license appeal hearing.
